Terms of Service

These terms set out the rules for using TruckThrust. Please read them alongside our Privacy Policy.
1. Agreement to these terms
These Terms of Service (“Terms”) govern your use of the TruckThrust mobile app, dispatcher dashboard and website (together, the “Service”), provided by Kaaal Int Lda, [registered address], Portugal (“TruckThrust”, “we”, “us”).
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service on behalf of a company, you accept these Terms for that company and confirm you are authorised to do so.
2. The Service
TruckThrust brings EU compliance, routing, documentation and parking into one driver-first app, with a companion dispatcher dashboard. We may improve, add, or remove features over time. The Service is a tool that supports compliance and operations; it does not replace your own legal duties (see §9).
3. Accounts and eligibility
- The Service is for professional use by people aged 18 or over.
- You must provide accurate account information and keep it up to date.
- You are responsible for keeping your credentials secure and for activity under your account.
- Operators are responsible for the accounts and use of the drivers and staff they invite.
4. Acceptable use
You agree not to:
- use the Service unlawfully or in breach of these Terms;
- disrupt, overload, or attempt to gain unauthorised access to the Service or its systems;
- copy, reverse-engineer, or create derivative works from the software, except as permitted by law;
- upload unlawful, infringing, or malicious content;
- exceed documented API rate limits or use the API other than under our developer terms.
5. Your content and data
You retain ownership of the data and documents you submit (“Customer Data”). You grant us the licence needed to host and process Customer Data to provide the Service. We handle personal data in line with our Privacy Policy and, where we act as your processor, a data-processing agreement. You can export your data at any time — there is no data lock-in.
6. Plans, fees and billing
Paid plans, fees and billing cycles are those set out in your order or on our pricing page. Unless stated otherwise, fees are exclusive of applicable taxes, and subscriptions renew and may be cancelled as described in your plan [complete with your billing specifics]. Where the Service is offered free or on trial, we may change or withdraw it.
7. Intellectual property
The Service, its software, and the TruckThrust name and brand are owned by us and our licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. No rights are granted except those stated in these Terms.
8. Third-party services
The Service may connect to third-party services — for example TMS or telematics providers via our API, mapping, and payment providers. Those services are governed by their own terms, and we are not responsible for them.
9. Compliance responsibility
TruckThrust provides decision support — for example driving-time calculations, cabotage counts, document capture, and rest reminders. You remain solely responsible for complying with all applicable laws and regulations, including Regulation (EC) 561/2006, tachograph rules, and cabotage and customs requirements. We do not guarantee that using the Service ensures compliance, and we are not liable for fines, penalties, or losses arising from your legal obligations.
10. Warranties and disclaimers
The Service is provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim implied warranties. We aim for high availability but do not warrant that the Service will be uninterrupted or error-free.
11. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential losses, lost profits, or loss of data, and our total liability for any claim is limited to the fees you paid for the Service in the 12 months before the claim. Nothing in these Terms limits liability that cannot be excluded by law.
12. Suspension and termination
You may stop using the Service and close your account at any time. We may suspend or terminate access for breach of these Terms or for legal or security reasons. On termination you can export your data, after which we delete it subject to any records we must keep by law (see the Privacy Policy).
13. Changes to these terms
We may update these Terms as the Service and the law evolve. We will update the “last updated” date above and, for material changes, give notice in the app or by email. Continued use after changes take effect means you accept the updated Terms.
14. Governing law
These Terms are governed by the laws of Portugal, and the courts of Portugal have jurisdiction, without prejudice to any mandatory consumer protections that apply where you live.
